PERSONAL DATA TREATMENT POLICY
Although SARAGOÇA DA MATTA & SILVEIRO DE BARROS – SOCIEDADE DE ADVOGADOS, RL, located at Rua Carlos Testa, n.º 1, 5.º B, 1050-046 Lisboa (hereinafter referred to as ‘SM&SM’) is subject to strict legal regulations of secrecy and confidentiality, we comply with the New General Data Protection Regulation – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April.
In SM&SB, we favor the privacy of our Clients, in addition to clarity and transparency in our relations with the same. Thus, with this Personal Data Treatment Policy, we hereby inform you that we collect and process personal data of Clients, as well as all those involved in the Clients´ files in order to render the requested services.
SM&SB reserves the right to modify this Personal Data Treatment Policy, where all amendments can be found in SM&SB’s website.
1. Controller of the personal data:
The controller responsible for the processing of your personal data is SARAGOÇA DA MATTA & SILVEIRO DE BARROS – SOCIEDADE DE ADVOGADOS, RL (SM&SB).
2. What personal data or information we collect:
In order to perform our services, we can collect and process personal data offered by the Client, regarding himself or third parties related to the services we are requested to render and is limited to that purpose.
With the prior explicit consent of the Client or of third parties, personal data can be requested to send legal or corporate informative communications of SM&SB to the clients or to third parties (newsletters or sending communications with legal or corporate information, hereinafter referred to as ‘Informative Communications’).
3. How we use the collected personal data:
SM&SB collects and processes the personal data of the Client mainly because they are necessary to perform the legal services rendered by SM&SB, to comply with legal obligations, namely, the legislation on prevention of money laundering and tax obligations, and for the continuation of the legitimate interests of SM&SB.
The personal data collected and processed for the purposes of the Informative Communications are mainly used to manage the system of release of communications and information to Clients and Third Parties, on legal information and corporate information of SM&SB. In relation to personal data collected for the purpose of Informative Communications, the Client or the third parties (‘data subjects’) can object to the data processing for this purpose at any time and by any means.
4. For how long do we store your data:
The personal data of the Client and of the third parties related to the rendering of services will be stored for the legal period strictly necessary to perform the legal and contractual obligations applicable to SM&SB.
The personal data collected and processed for the purposes of the Informative Communications are stored until the data subject exercises his right to be forgotten, his right to objection or right to restriction of processing.
5. Personal data are shared or transmitted to third parties:
SM&SB will not share the personal data of the Clients and of the third parties in relation with the provision of services with third parties, except where the compliance with legal obligations is necessary (i.e., official entities, such as Tax and Customs Authorities, judiciary or judicial entities, etc.), or with providers regarding the fulfilment of such legal obligations (for example, certified accountants, auditors, filing purposes, hereinafter referred to as ‘Partners and Providers’), and for the rendering of legal services, in this case, with the knowledge and/or by request of the Client.
Personal data collected and processed for the purposes of Informative Communications, as a rule, are not transmitted or shared with third parties. Exceptionally, SM&SB can share such data with Partners and Service Providers that provide web services which are necessary to the release Informative Communications, within the strict limit necessary for such purposes.
In any case, SM&SB requires their Partners and Providers that must access the personal data exclusively to provide the necessary services to act always in accordance and in compliance with the current legislation, with particular concern on protecting confidentiality under the legal rendering of services. I.e., whenever SM&SB uses processors (Partners and Providers) for personal data treatment purposes, namely for archive management, certified accountants, auditors or other service provision, these entities are obliged to develop suitable technical and organizational measures to protect the data and ensure the protection of the rights of the data subject.
6. Where personal data are stored:
Information containing personal data shall be stored in the databases of SM&SB and, whenever necessary and in a limited manner, in the databases of our Partners and Providers. In any case, SM&SB will not transmit personal data outside the European Union or the European Economic Area.
These databases are in Cloud Providers, which will be located within the European Union or the European Economic Area.
7. Right of access to personal data:
We guarantee the Client and the personal data subjects the right to data portability and the rights of access, rectification, erasure, to object and to restrict their personal data in accordance with the applicable legal terms. The exercise of the respective rights can be requested by email to email@example.com or by written request sent to Rua Carlos Testa, n.º 1, 5.º B, 1050-046 Lisboa. However, we must stress that such data might have to be stored for exclusive purposes of archive, if required by Law.
The subjects of personal data collected for Informative Communications purposes can also object, at any moment, to the use of such personal data to the purpose of Informative Communications, or even to require the removal of such data.
The Client and the subjects of personal data collected for Informative Communications purposes always maintain the right to submit a complaint with the supervisory authority (Portuguese Data Protection Authority).
